Booking Terms and Conditions

1. About Colour by Shann

Colour by Shann is the trading name of Shannon Harford, a sole trader operating from London, England.

Our correspondence email address is [email protected].

These terms apply to colour analysis appointments booked through our website, booking platform or another booking method approved by Colour by Shann.

A contract is formed when we accept your booking, receive any payment required and send you a booking confirmation.

2. Our colour analysis service

Colour by Shann provides professional, in-person colour analysis using the 16 Season Colour Analysis system.

The service may include:

  1. An assessment of your natural colouring and colour characteristics.
  2. Comparative fabric draping.
  3. Identification of your most harmonious seasonal colour palette.
  4. Guidance on colour combinations, neutrals, metals and personal style choices.
  5. Any take-home palette, guide or other materials described in the service listing.

The precise contents, duration, price and location of your appointment will be shown on the relevant service page and in your booking confirmation.

We will provide the service with reasonable care and skill, as required by the Consumer Rights Act 2015.

3. The nature of colour analysis

Colour analysis involves trained observation, comparison and professional judgement. Your result will be based on professional opinion, the colouring and characteristics observed during your appointment under the lighting and conditions used for the analysis.

The service is intended to provide informed personal guidance. It does not restrict the colours you may wear, and it does not guarantee that you will personally prefer every colour within your recommended palette.

Colours may also appear different depending on lighting, fabric, dye batches, photography, printing and screen settings. A product described using the same colour name as one within your palette will not necessarily be an exact match.

Significant changes to hair colour, tanning, cosmetic products or other aspects of your appearance may affect how particular colours appear alongside your colouring.

Nothing in this section limits your legal rights where a service has not been delivered with reasonable care and skill or as described.

4. Booking and payment

The person making the booking must be at least 18 years old. Anyone under the age of 18 must be accompanied by an adult for the duration of the booking.

Full payment is required at the time of booking unless we have agreed otherwise in writing.

All prices are shown in pounds sterling and include VAT where applicable.

We may change our prices from time to time. A price change will not affect an appointment that has already been confirmed and paid for.

You are responsible for checking that the name, email address, appointment date, service and other information within your confirmation are correct.

5. Discount codes and promotional offers

Discount codes are subject to any conditions stated when they are issued.

Unless otherwise stated:

  1. Only one discount code may be used for each booking.
  2. A code must be entered before payment and cannot normally be applied retrospectively.
  3. Codes have no cash value and cannot be exchanged for money.
  4. Codes may be limited by service, client, date or availability.
  5. A discount cannot be used in conjunction with another promotion unless expressly stated.

We may withdraw a promotion before a booking is made, but this will not affect a booking already confirmed using a valid code.

6. Statutory cancellation rights for distance bookings

This section applies where you book online, by telephone, by email or otherwise at a distance, and where the statutory cancellation provisions apply to your contract.

You may have the right to cancel your booking within 14 days, beginning on the day after the contract is formed, without giving a reason.

Where you exercise this right before the service begins, you will normally receive a refund of the amount paid.

If your appointment is due to take place during the 14-day cancellation period, we will ask you to expressly request that the service begins during that period.

If the service is fully completed during the 14-day period, after you have made that request and acknowledged the effect on your cancellation rights, your statutory right to cancel will end once the service has been fully performed.

If you ask us to begin providing the service during the cancellation period and then cancel after part of the service has been provided, you may be required to pay a proportionate amount for the service already supplied.

You may tell us that you wish to cancel by emailing [email protected]. You do not have to use a particular form, although your communication should clearly identify you and the booking being cancelled.

These statutory rights are separate from the appointment cancellation policy below.

7. Appointment cancellations and rescheduling

After any applicable statutory cancellation period has ended, the following appointment policy applies.

7.1 More than 48 hours before the appointment

You may cancel or request to reschedule by giving at least 48 hours’ notice. You may either receive a refund or transfer your payment to one mutually appropriate alternative appointment. A booking may normally be rescheduled once. A further request to move the appointment may be treated as a cancellation.

7.2 Less than 48 hours before the appointment

Where less than 48 hours’ notice is given, it may not be possible to offer the reserved time to another client. In these circumstances, Colour by Shann may retain an amount from the fee to cover its reasonable loss arising from the cancellation. This may include some or all of the appointment fee where the time cannot reasonably be filled.

If we are able to fill the appointment with another client, we will take this into account when calculating any amount retained.

7.3 Failure to attend

If you do not attend your appointment and have not contacted us beforehand, the booking will be treated as a no-show. The appointment fee will normally be retained, subject to our obligation to act fairly and reasonably.

7.4 Exceptional circumstances

We understand that illness, emergencies and unexpected events happen. We may agree to transfer a booking outside the usual policy where the circumstances reasonably justify it. Any such decision will be made individually and does not create an obligation to make the same exception in another case.

Cancellation and rescheduling requests must be made by email to [email protected]. Notice takes effect when the request is received and acknowledged.

8. Late arrival

Please arrive at the time stated in your booking confirmation.

If you arrive late, we will do our best to provide the service within the remaining appointment time. However, your appointment may need to be shortened so that subsequent clients are not inconvenienced.

The full appointment fee will remain payable where a session is shortened because of your late arrival.

If you arrive more than 15 minutes late, we may be unable to provide a reliable or complete analysis. The appointment may then be treated as a late cancellation, taking account of the circumstances and the loss reasonably incurred.

9. Preparing for your appointment

You agree to read and follow any preparation guidance sent before your appointment.

You should attend without makeup and fake tan, as these can alter the analysis of your undertone, ultimately impacting the results of your analysis.

Please contact us before the appointment if you are unable to follow any part of the guidance.

Where preparation materially affects our ability to carry out an accurate analysis, we may need to adapt, shorten or rearrange the appointment. We will discuss the available options with you and act reasonably when deciding whether any additional payment is required.

10. Health, accessibility and additional needs

Please tell us before the appointment about any accessibility requirements or reasonable adjustments that may help you participate comfortably.

Where cosmetic or skincare products will be demonstrated or applied, you must tell us about any relevant allergies, sensitivities or medical concerns before they are used.

Colour analysis is not medical, dermatological or healthcare advice. You should seek advice from a suitably qualified professional concerning any health or skin related concern.

11. Conduct and safety

We want every appointment to feel welcoming, comfortable and respectful.

We may refuse to begin or may end an appointment where a person:

  1. Behaves in a threatening, abusive, discriminatory or inappropriate manner.
  2. Appears significantly intoxicated.
  3. Creates a risk to their own safety or that of another person.
  4. Deliberately damages property or seriously disrupts the service.

Where an appointment is ended for one of these reasons, any amount retained will be limited to the reasonable loss and costs arising from the situation.

12. Appointments booked for another person

Where you make a booking for someone else, you confirm that:

  1. You have their permission to provide the booking information.
  2. You will make these terms and the appointment preparation guidance available to them.
  3. The person attending understands what the service involves.

The contract remains with the person who made the booking unless we agree otherwise in writing.

13. Cancellation or changes by Colour by Shann

We may occasionally need to cancel, move or adapt an appointment because of illness, an emergency, unsafe conditions, venue problems, severe weather or another circumstance outside our reasonable control.

Where we cancel an appointment, you may choose between:

  1. Transferring the full amount paid to an alternative appointment.
  2. Receiving a full refund for the cancelled service.

We will contact you as soon as reasonably possible using the details supplied when booking.

We are not responsible for additional travel, accommodation, childcare or other costs unless we have agreed to them in writing or are legally required to reimburse them.

14. Personal palettes and client materials

Any palette, card, guide or report supplied as part of your appointment is intended for your personal use.

You may use it to guide your own wardrobe, shopping, beauty and styling decisions. You may not copy, reproduce, resell, teach from, distribute or commercially exploit Colour by Shann’s branded materials without prior written permission.

Colour by Shann does not claim ownership of individual colours, seasonal names or general colour analysis principles. It does retain rights in its original wording, layouts, graphics, photographs, guides, templates and branded materials.

15. Photography, video and testimonials

We will not use an identifiable photograph, video, testimonial or client story for public marketing solely because you have accepted these Booking Terms.

Any marketing use will require a separate and optional consent choice explaining:

  1. What material will be used.
  2. Where it may appear.
  3. Whether your name will be included.
  4. How you may withdraw consent for future use.

You may decline marketing consent without this affecting your ability to book or receive the service.

You may not make an audio or video recording of the appointment without our prior agreement.

16. Privacy and personal information

We will handle your personal information in accordance with our Privacy Policy and applicable data protection law.

Our Privacy Policy explains:

  1. The information we collect.
  2. Why we use it.
  3. The lawful bases on which we rely.
  4. The service providers with whom information may be shared.
  5. How long information is retained.
  6. Your data protection rights.
  7. How to contact us about your information.

Acceptance of these Booking Terms does not constitute consent to receive marketing communications. Marketing preferences will be managed separately.

17. Website content

The text, photographs, logos, graphics and original materials on the Colour by Shann website belong to Colour by Shann or are used with the owner’s permission.

You may view and use the website for personal, non-commercial purposes. You may not reproduce, republish, scrape or commercially exploit its content without permission.

Information provided through the website, social media or articles is general in nature and is not a substitute for an individual colour analysis.

We do not control third-party websites linked from our website and are not responsible for their content, availability or privacy practices.

18. Liability and your consumer rights

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for:

  1. Death or personal injury caused by negligence.
  2. Fraud or fraudulent misrepresentation.
  3. A breach of your statutory consumer rights.
  4. Any other liability that cannot legally be excluded.

We are responsible for losses that are a foreseeable result of our breach of contract or failure to use reasonable care and skill.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed, or for business losses arising where you booked the service wholly or mainly for personal purposes.

You remain responsible for your own clothing, beauty and purchasing decisions made following the appointment. Colour by Shann does not guarantee the suitability, quality, availability or performance of products sold by other businesses.

19. Complaints

We hope you will be delighted with your experience. If something has not met your expectations, please contact us at [email protected] so that we have an opportunity to understand and address the concern.

Please include:

  1. Your name and appointment date.
  2. A clear description of the concern.
  3. The outcome you are seeking.
  4. Any relevant supporting information.

We will acknowledge the complaint within five working days and aim to provide a substantive response within 14 working days. Where more time is reasonably required, we will explain why and provide an updated timeframe.

20. Governing law

These terms and any contract between you and Colour by Shann are governed by the laws of England and Wales.

If you live elsewhere in the United Kingdom, this does not remove any mandatory consumer rights or protections that apply where you live. Any legal proceedings may be brought in a court that has jurisdiction under the applicable law.

21. Changes to these terms

We may update these terms to reflect changes to our services, systems or legal obligations.

The terms applying to your appointment will normally be the version in force when your booking was confirmed. A later change will not retrospectively alter an existing booking unless:

  1. The change is required by law.
  2. You expressly agree to it.
  3. It is a minor administrative change that does not reduce your rights.

The date of the latest version will appear at the top of this document.
